Abstract: 

Gaines v. Jones, 2019 1400470 (M.D. Fla.), is stunning in the allegations aimed at Corizon Health, Inc., the health care provider for the Florida prison system. Plaintiff’s son died from starvation while confined by the Florida DOC and under the care of Corizon. The decedent was 5’9” and weighed 190 lbs. when he entered the system. He was diagnosed with bipolar disorder and mania with psychotic features. Sixteen months later, he weighed 151 lbs. and was refusing medication, not sleeping and not regularly eating. About a year later, with decedent off his Tegretol and no sodium tests provided, the death occurred, and decedent now weighed 115 lbs. The autopsy found malnutrition. This man, indeed, starved to death under the watchful eyes of FDOC and Corizon. Corizon’s motion to dismiss, with which we will concern itself here, was denied.
