Illinois and Rasho v. Walker: A Permanent Injunction Issues

Abstract:
In Rasho v. Walker, 2019 WL 1771798 (C.D. Illinois), Judge Michael M. Mihm found that the Illinois DOC was not in substantial compliance with a 2015 Settlement. IDOC blamed Wexford for the compliance problems but Judge Mihm noted that IDOC cannot shirk its constitutional obligations by delegating them elsewhere. In this version of Rasho, the earlier settlement is kept in place, Pablo Stewart, M.D., continues as the Monitor and a series of directives are issued in this 41-page Permanent Injunction Order. In this article, we review the key elements in Judge Mihm’s Order, focusing on five vital areas: mental health evaluations, treatment planning, medication management, mental health care for inmates held in penal isolation and mental health care on crises watch.Keywords: Rasho v.
