Abstract: 

Justices Sotomayor and Ginsburg dissented from the denial of review in a case where the defendant claimed that his court-appointed counsel provided ineffective assistance at the capital sentencing phase of his trial. This article explores the possibility of mitigating circumstances in the sentencing of a defendant with suspected brain damage that was not introduced during the trial.
