Abstract:

In a recent Indiana case, an appellate court held that a person holding a life interest in real estate could not require that the property be partitioned and sold over the protest of the foundation holding the remainder interest in the property (Scottish Rite of Indianapolis Foundation, Inc. v. Barbara A. Adams, 834 N.E.2d 1024 (Ind. Ct. App. Sept. 29, 2005)).
