Abstract: 

In Johnson v. Tinwalla, 855 F.3d 747 (7th Cir. 2017) a Wexford employed psychiatrist failed to follow Illinois procedure for ordering forced medication by writing a prescription for Risperdal for an inmate who had refused the drug, then ordering it to be dispensed along with his other medications without the inmate’s knowledge. The 10th Circuit reversed district court’s summary judgment for defendant, who will now have to justify tricking his patient into taking a drug he didn’t want.
