Abstract: 

In Dabilis v. Hillsborough County, 2017 WL 1101070 (D.N.H.) a court rule in favor of defendants who were charged with violating the Americans with Disabilities Act when they used pepper spray to extract a mentally disordered inmate from his cell. We examine the facts supporting defendants in an unusual case in which a former C.O. with no mental health credentials was accepted by the court as an expert witness.
