Abstract: 

A hospitalized patient who had become violent and threatened nursing and medical staff was hog-tied then Tasered by responding sherriff’s deputies. The restraints aggravated a hypoxic condition, and the patient died. We examine why the 10th Circuit ruled that the officers were not negligent and are not legally liable for the death.
