Abstract:

Considering the thousands of campus conduct complaints handled each year in the United States, the number of conduct-related lawsuits filed against institutions and their officials is relatively small. Smaller still is the number of complaints in which plaintiffs prevail. Nonetheless, any lawsuit can be an unpleasant ordeal and administrators would rather not to be sued in the first place. This article relates administrator-student communication to doctor-patient communication, medicine being a field in which lawsuits are very expensive.
