Abstract: 

Although it is assumed that the reason for assessing a particular sentence is based on a philosophical understanding of the purpose of punishment, that is seldom the case. Part of the reason is due to the inherent constraints and even contradictions in the criminal justice system. This article examines the philosophical underpinnings of punishment—retribution, deterrence, incapacitation, and rehabilitation—the weaknesses of these philosophical justifications, and why community corrections may be the one place in the system that can create a more just, humane, and effective response to offending behavior.
