Abstract: 

Elsewhere in this issue we discuss cases involving a donor's ability to enforce conditions on a grantee. What about the reverse situation? Can a grantee successfully sue a donor who doesn’t actually ante up the promised funds? A recent federal appeals court decision upheld a lower court ruling holding that a foundation was liable for $377,000 in damages and an additional $100,000 in punitive damages for failing to follow through with grants it had promised. And, in a surprising turn of events, an officer of the foundation was also held liable.
