Abstract:

Editor’s Note: We have published several articles since Kansas v. Hendricks, 521 U.S. 346 (1997), regarding the constitutionality of civil commitment. We have not published many articles about the process of civil commitment, but we are honored to include in this issue of SLR two such articles by experts in this area: one by Warren Maas, a frequent contributor to SLR; the second by another frequent contributor, Jack Furlong, which appears on page 65.Maas’ article, below, is the first of a multipart article that provides a general overview of the evolution of commitment procedures. Later installments will show the link between commitment and due process issues post-commitment.
