Abstract:

This article examines the disparity in the ways victims of commercial sexual exploitation are treated within the justice system and considerations at play when prosecutors encounter victims of trafficking as defendants in criminal cases. Ultimately, this article considers how prosecutors are uniquely situated to help decrease inroads into sexual exploitation and provide avenues or off-ramps from that exploitation for victims who are in “The Life”—that is, the life of being trafficked.
