Abstract: 

In PLR 200542032, permitting the transfer of “firm transmission rights” of transmission facilities was not a deliberate action causing the financing bonds to be private activity bonds under Section 141 of the 1986 Code or as industrial development bonds under Section 103(b) of the 1954 Code.
