Abstract:
Two recent California Court of Appeal decisions examine elder abuse issues: One concerns a question of litigation of financial elder abuse cases; the other, health care institutions’ liability for the allegedly wrongful death of a patient. In both decisions, statute of limitations issues were significant—showing the vital importance of filing claims promptly, not only so that witnesses’ memories will be fresh and data will be available, but to avoid dismissal of the case.Keywords: statute of limitation issues; importance of filing abuse cases promptly; spousal rights
