Elders and the Disabled in Prison

Abstract:
Shortly after being imprisoned for defrauding his mother, Brooke Astor, 89-year-old Anthony D. Marshall was found eligible for medical parole by the parole board. This article examines the practice of “medical parole” and illustrates how Marshall, who suffers from Parkinson’s Disease, congestive heart failure, memory loss, and confusion, is typical of a large and growing cohort of inmates now being considered for “compassionate release” as prisons seek to relieve overcrowding by paroling those deemed to no longer pose a threat to society.Keywords: Brooke Astor; Anthony D.
