Abstract: 

Highlights from a webinar on recovering property lost to financial exploitation (FE). The advantages of civil remedies versus criminal prosecution and the important role civil lawyers can play in the protection against FE are explained as well as the legal tools available to take action against the perpetrator. Several hypothetical cases are presented illustrating the dangers of diminished capacity and undue influence, and the steps that Maine Legal Services for the Elderly is taking to recognize, protect and prosecute elder FE. Also included is a sidebar on “Asset Recovery” scams targeting victims.
