Abstract: 

In Aswat v. The United Kingdom, The European Court of Human Rights (April 16, 2013), held that there would be a violation of Article 3, Convention for the Protection of Human Rights (Convention) if preacher Abu Hamza, the applicant, were to be extradited from England to the United States to face charges of terrorism. Aswat’s counsel argued that he was somewhat stabilized at Broadmoor and any uprooting to a place and environment as yet unknown would be incompatible with Article 3.
