Abstract: 

FBI agents seized Demma’s computer and discovered 3,600 child-porno images along with 230 videos. He pleaded guilty to possession of child pornography. Within the framework of U.S. Sentencing Guidelines, Demma’s offense, along with prior offenses, corresponds to a prison term of between 78 and 97 months. Demma sought and received from the trial court a term of noncustodial confinement—in effect, the one-day prison sentence. In U.S. v. Demma, the court reversed the sentence, as it had the power to do, and vacated the headline grabbing one-day sentence.
