Abstract: 

It will not be a common occurrence that our readers encounter legal issues involving a former head of state seeking bail in conjunction with an extradition proceeding. The former president (of Peru) is Alejandro Toledo Manrique, governing from 2001 to 2006. Peru seeks to try him on charges of accepting bribes from a Brazilian mining company. Toledo was arrested in July 2019 and denied bail. The denial was challenged in the Matter of the Extradition of Alejandro Toledo Manrique, 2020 WL 1037998 (9th Cir.), and the finding was that Toledo was not a flight risk and there was a prominent risk to his deteriorating mental health due to confinement in ad seg in Oakland’s notorious Santa Rita jail. The court finds that changes have undermined the bail release order under review. Toledo’s wife is found to have not disclosed some $1 million which could assist in flight. The court’s decision cited testimony from expert witness Craig Haney regarding conditions in the jail’s administrative segregation unit.
