Abstract: 

Stevens-Rucker v. City of Columbus, 739 Fed. Appx. 834 (6th Cir. 2018), is an awkward appellate decision. Viewed in its most general terms the case involves the police shooting and killing a seriously mentally ill, Iraq war veteran who accidentally stumbled into a neighbor’s apartment. Jason White clearly was confused and disturbed. White left the female neighbor’s apartment and she made a 911 call. Police responded and an ultimately fatal encounter ensued with White shot and first wounded then killed by subsequent volleys when he fell and allegedly seemed to push himself up.
