Abstract:

Matherly is pursuing an argument against comingling civil committees with a criminal population. Although the 4th Circuit ruled against his claim, there clearly needs to be a greater delineation between the criminally and civilly confined in sex offender treatment, as this case illustrates.

Keywords: Civil and criminal confinement; rights of participants in sex offender treatment; Matherly v. Andrews; Youngberg v. Romeo, 457 U.S. 307 (1982)
