Abstract:
As of Spring 2001, 29 states had a statute, regulation, or rule that provides for more severe penalties for DUI/DWI offenders with a “high” BAC, that is, a BAC threshold (for example, 0.15% or 0.20%) above the level for a standard DUI/DWI charge (that is, 0.08% or 0.10%). This article summarizes a report on states’ high-BAC sanctioning systems, prepared as part of a comprehensive evaluation of high-BAC sanction systems; the study is sponsored by the National Highway Traffic Safety Administration.Keywords: DUI/DWI; MADD; The Century Council; National Transportation Safety Board (NTSB); Transportation Equity Act of the 21st Century (TEA-21);
