Abstract:
Although the court found inmate Haleb Solebo partly “contributory” for his failure to take prescribed anti-seizure medication, the Metropolitan Correctional Center in Chicago was found liable for wrongful death under the Federal Tort Claims Act (FTCA), where the liability standard is negligence and not the ultra-demanding test of deliberate indifference. As Cohen explains, administrators and health providers need to understand the conditions that make a FTCA claim likely. Keywords: Ford-Sholebo v. United States, 2013 WL 4733998 (N. D. Ill.)
