Abstract: 

In Smith v. Fischer, 2012 WL 4901653 (2nd Cir.), a panel of the Second Circuit (New York) Court of Appeals briefly dealt with inmate claims to a special diet as a heart attack survivor and that there was deliberate indifference to an inmate’s medical needs due to the means of restraint used during his transportation from the prison to the Albany, New York Medical Center. These are claims frequently encountered but not often litigated to judgment. In this decision, each issue receives the attention of a respected federal court and there is straightforward guidance here for practitioners.
