Abstract:

Our regular review of cases involving the delivery of health care in prisons and jails includes coverage of Morales v. Donnelley, a suit filed against a Nevada prison that resulted in a temporary injunction against the Lovelock Correctional Center for failure to provide an inmate with prescribed medications on a timely basis; a case in which a P.A. was sued when he determined that an inmate was not a suitable candidate for a hernia operation, with the court ruling that the inmate could not sustain a constitutional claim for a disagreement over treatment options; and suit filed by a Florida state prisoner who was denied a hearing aid because he still had hearing in one ear, a case in which the 11th Circuit overturned a district court dismissal, allowing the case to proceed to trial or settlement.
