Abstract:

The Navajo Nation courts revived Navajo peacemaking, the traditional Navajo justice procedure, in 1982 and used it for several years before the restorative justice movement emerged. One of the big debates we had was whether or not Navajo peacemaking is a form of “restorative justice.” On the one hand, what Navajos do to solve problems in a Navajo way is completely unique. On the other, restorative justice is flexible enough to accommodate all kinds of thinking about innovative justice methods.
