Abstract: 

What happens when a husband and wife decide to separate and the family holdings include a private foundation? Can each spouse take half, splitting the foundation as they might divide a retirement account or some other joint asset? A recent Ohio case, Mikhail v. Mikhail, 124 Ohio Misc. 2d 5, 791 N.E.2d 468 (4/3/03), 2003 Ohio Misc. LEXIS 15, held that they could not, since their family foundation (like all foundations) was irrevocable.
