Abstract: 

The law of charity in England originates from the preamble to the Statute of Elizabeth of 1601. It is still good law and Lord Mcnaughten in Pemsel’s case1 distilled the preamble by setting out four discrete charitable purposes being the advancement of education,2 the advancement of religion, the relief of poverty, and the promotion of other purposes beneficial to the community (“the heads of charity”).
