Treasury and IRS Issue Proposed Regulations on Type III Supporting Organizations

Abstract:
On September 23, 2009, the Treasury Department and IRS released proposed regulations (REG-155929–06) regarding the requirements for qualification as a Type III supporting organization (one operated in connection with one or more public charities). These proposed regulations reflect extensive changes made to those requirements by the Pension Protection Act of 2006 (PPA). Treasury and IRS took the rare step of issuing an Advance Notice of Proposed Rulemaking (ANPR) on this subject in December of 2007, but these proposed regulations differ in several important respects from the ANPR.Keywords:
