Abstract:
Our regular review of recent decisions includes a ruling that participants in extracurricular sports assume not only the general risks of the game but also the risk of being injured by intentional acts; an appellate court’s of law school graduates’ claims of fraud in connection with job placement statistics the school had promoted; a similar dismissal of a suit by graduate students seeking to recover damages for “investment” in a graduate degree program that failed to lead to employment; a ruling in U.S. District Court against the University of New Mexico in a case in which the professor teaching a course described in the catalog as promising free discussion of controversial topics refused to grade a paper submitted by a student who expressed views strongly opposed to the professor’s; and a ruling that universities are subject to provisions of the Fair Credit Reporting Act with respect to information provided to credit reporting agencies regarding student accounts.Keywords: Avila v.
