Abstract:
Blending a donor’s wishes with a charity’s needs is an important element in philanthropy. More often than not, donors want recognition and charities desire unrestricted funds. Blending both aspects is an art, not a science. Journals and newspaper articles are replete with examples of substantial gifts that resulted in major issues. Underfunding, overfunding, naming right issues, program issues, as well as misunderstandings can create significant headaches for all involved. Avoiding issues is the major goal of gift acceptance agreements. Properly structured, the agreement can avoid misunderstandings and, even worse, litigation. Further, unhappy donors are not good ambassadors for the charity involved. Keywords: Gift Acceptance Agreements; Restrictive Gifts; Naming Rights Gifts; Overfunded Gifts; Matching Gifts; Testamentary Gifts
