Abstract: 

On February 12, 2019, National Taxpayer Advocate Nina E. Olson released her 2018 Annual Report to Congress (the “Report”). As required by IRC §7803, the Report identifies the 10 tax issues most litigated in federal courts, and charitable contribution deductions under IRC §170 made the list. This article examines the common issues that trigger litigation, including substantiation, valuation, and contributions of easements, and examines in detail several important cases illustrating typical ways charitable deductions can run afoul of IRS regulations.
