Abstract: 

In February 2013, the United States Sentencing Commission released its official report, “Federal Child Pornography Offenses,” to Congress. While focusing predominantly on those convicted of non-production offenses under U.S.S.G.§ 2G2.2, the report also analyzed sentencing issues surrounding production of child pornography offenses under U.S.S.G. § 2G2.1. Shortly following the report’s official release, the U.S. Department of Justice issued a detailed letter responding to the report and its conclusions, agreeing with certain core premises and challenging others.
