Abstract:
In the 2012 November election, California voters overwhelmingly approved Proposition 36, which implemented changes to the state’s existing three-strikes law. (Chapter 12, Statutes of 1994 (AB 971, Jones).) The main idea behind the changes involved inserting language specifying “serious” or “violent” felony requirements for the third strike, but the changes also excluded many instances that could involve sex offenders.Keywords: Proposition 184, failure to register, non-serious, non-violent felony, People v.
