Abstract: 

Preventive detention and the civil commitment of sex offenders have been focuses of American constitutional litigation for almost 20 years. These issues are beginning to find their way into European jurisprudence, as European legislation, and American sex offender laws, are judged under the European Convention on Human Rights (ECHR). This article surveys commitment statutes around Europe and ECHR and other court rulings on their validity and consitutionality.
