Sex Offender Law Report

Abstract:

The history of this case goes back quite some time. Andre Brigham Young was convicted of six rapes over three decades. Young had been scheduled for release from prison for his most recent conviction in October 1990. One day prior to his scheduled release, the state filed a petition to commit Young as a sexually violent predator. At the hearing, experts testified on both sides. The state’s expert concluded that Young’s condition (severe paraphilia) in combination with a severe personality disorder, the span of time during which Young committed his crimes, his recidivism, and his persistent denial and lack of remorse made it more likely than not that he would commit further sexually violent acts. A jury unanimously concluded that Young was a sexually violent predator.
