Abstract: 

In this first of a multipart series, the author examines the history of jurors’ knowledge and use of the nullification option—the exercise of determining a verdict inconsistent with the law as applied to the facts in the case. The article discusses the reasons for jurors’ exercise of such an option and examines several of the cases in which the nullification option was exercised.
