Abstract: 

Editor’s Note: Sexual harassment has been increasingly prominent in workplaces and courts nationwide. But same-sex sexual harassment has held only a minor place in the legal harassment landscape. The article below sets forth the legal standards for sexual harassment in the workplace, with mention of such claims on college campuses, and summarizes a Supreme Court case that addressed the issue of same-sex sexual harassment. It also discusses the conflicting case law that has derived from that case and suggests that the standards for such cases are unclear because the terms are unclear, and perhaps even prejudiced.
