Abstract:
It may be surprising to know that there exists a significant number of convicted sex offenders who are not child molesters, who do not meet the psychiatric criteria for pedophilia, and who are not a threat to the community. Nonetheless, there is a class of offenders who have been convicted of felony crimes owing to their possession of Internet child pornography or pornographic images of minors. While the number of actual child pornographic images vary among those arrested for this crime, the retributivist nature of federal sex offender legislation ensures a minimal chance that the defendant in these cases will avoid conviction or subsequent sex offender registration under Megan’s Law.Keywords:
