Abstract: 

Within sex offender civil commitment proceedings, courts often are offered testimony from clinicians who have conducted psychological treatment with the respondent/patient. Such testimony is typically offered to describe how well or poorly the individual has done in treatment to date. At least by implication, this testimony is often offered to help the court determine the individual’s degree of recidivism risk; not just to inform about treatment progress. This article is to raise concerns about the appropriateness of the implied meaningfulness of such testimony.
