Abstract:
The article below continues the saga of the Duke lacrosse team that resulted not only in a rigorous examination of the subculture of the team and its players on the University’s campus, but also in an eruption of unspoken hostilities and prejudices that existed in the wider community of Durham. (See Roslyn Myers, J.D., “Duke Lacrosse Case: Race, Class, and Prosecutorial Misconduct, Part I,” 9 (3) SLR 33 (Apr./May 2008).) Even when the allegations of rape made by a Durham community member against several team members appeared to have been fabricated, prosecutorial ambition overcame common sense and legal standards to buoy the case through the criminal justice system well beyond what was reasonable or appropriate. Everyone, touched by the case, whether directly or indirectly, was affected.Keywords:
