Abstract:
The Trouble With Drink: Intoxication, (In)capacity, and the Evaporation of Consent to Sex by Dr. Sharon Cowan. This article examines situations in which consent is absent because of incapacity through intoxication. It begins with a brief review of past literature “to clearly define what is meant by consent.” Prior work on this topic has focused on “determining whether consent is a state of mind, or whether consent is constituted by a set of actions or behaviors, performed in a certain way.”Keywords:
