Abstract: 

In California, SB 435, the recently introduced “Ending Online Sexual Trafficking and Exploitation Act” allows victims of online sexual exploitation and trafficking the ability to directly bring civil causes of action against those who have participated in the distribution of explicit images in photographs and video. One of the proposed law’s core innovations is its focus on the digital environments, and on the difficulty of determining whether the person depicted is an adult or is consenting to the exploitative imagery and its distribution adds challenges to regulating the industry.
