BOP Lax in Monitoring Prisoner Depository Accounts and Payment Plans

Abstract:
Recent reports indicate that the Federal Bureau of Prisons has not fulfilled its duty to apply inmate account funds to court-ordered obligations for restitution. Former USA Gymnastics physician Larry Nassar, who is now imprisoned for sexually abusing hundreds of athletes and possessing child pornography, has been the focus of these concerns. Nassar still owes over $52,000 in restitution to his victims and over $5,000 in special assessments. This article examines the court-order restitution Nassar is presumably responsible for and how the Federal Bureau of Prisons has failed to ensure that Nassar’s obligations are met, even as Nassar accumulates assets in his prison depository accounts while making no restitution payments.Keywords: Restitution, Inmate Earnings, Depository Accounts, and Payment Plans
