Abstract:

This article addresses an ongoing debate as to the best method of protecting members of the public from potential sexual abuse by releasing information about suspected offenders. Specifically, there are questions about if, when, and how this should be done prior to a defendant’s conviction, when an accused individual is presumed to be innocent. Balancing an individual’s right to privacy against the protection of the public, particularly members of the public who are vulnerable, such as children, is especially difficult in cases involving sex crimes.
