Abstract:
Mathews v. Harris, 7 Cal. App. 5th 334 (2017), presents several interesting legal conundrums for sex offender treatment providers. Primarily, state mandatory reporting requirements regarding child abuse were amended in a way that allows state intervention in the therapeutic relationship. The serious concerns about the law’s conflicts with constitutional rights to privacy and patient confidentiality, among other concerns, are examined here. The court of appeals’ opinion also offers a primer on numerous other cases relevant to its analysis, which are included.Keywords: Child Abuse and Neglect Reporting Act (CANRA); Client-Therpist Confidentialty
