Abstract: 

Our review of recent appellate decisions includes In re Detention of Robinson, in which the Iowa Court of Appeals upheld a trial court ruling that sufficient evidence showed a sex offender suffered from a mental abnormality making him likely to engage in predatory acts constituting sexually violent offenses if not confined in a secure facility; United States v. Caillier, a case from the 5th Circuit ruling that a federal district court had jurisdiction to modify the conditions of a child pornography offender’s supervised release once he had begun serving his release period; In re McBrayer, a Michigan Supreme Court decision that a Parole Board did not clearly abuse its discretion in declining to depart from parole guidelines and deny parole, even if there were substantial and compelling reasons for departure; a D.C. Circuit ruling in Hickerson v. United States that sex offender registration was required even if a conviction had been set aside under the Federal Youth Corrections Act; Doe v. Sex Offender Registry Board, a Massachusetts appellate decision that no error was found in a Massachusetts Sex Offender Registry Board’s finding that a sex offender should be classified as a level two sex offender; a Nebraska ruling, State v. Sullivan, that additional sex offender conditions could not be added to conditions of post-release supervision for prisoner who had pled no contest to felony child abuse without a showing of changed circumstances; and decisions on child solicitation by electronic communication, and sexual conduct violating prison disciplinary rules and points assessments under NY law.
