Abstract: 

Sherry F. Colb, a Justia columnist, is the C.S. Wong Professor of Law at Cornell Law School. In this article, she examines several legal issues with regard to “consent” that are implicated in but have been ignored in the public conversation over the Texas anti-abortion law. SB8 contains no exception to its near-absolute prohibition against abortion for pregnancies that result from rape or incest; Colb believes we can learn a lot from this failure to grant an exception.
