Abstract:

Mutual orders of protection are sometimes issued in family violence situations. These are meant to indicate that both parties might be violent and therefore need protection from each other. However, such orders can be discriminatory towards the victims of abuse, and misleading: Victims who behave violently are often only trying to protect themselves or a loved one. Decisions in several recent court cases highlight the continuing diffi culties of mutual orders of protection.
