Abstract: 

The thesis of this section is best summarized by the following statement contained within: “The non-abusive parent’s immigration status should not be used to justify awarding custody to an abusive parent, betraying the children’s best interests.” The article then proceeds to outline legal strategies designed to circumvent the kind of unjust child custody outcomes that many abusers strive to bring about.
